Falmouth patrolman quits amid accusations

A Falmouth police officer has resigned amid allegations he physically and sexually assaulted his ex-girlfriend. Mario Cunha, 24, quit his job as a patrolman on Friday after a restraining order was filed against him the previous day... Falmouth District Court Judge Michael Creedon signed the order on Thursday after determining Cunha represented "substantial likelihood of immediate danger" to his ex-girlfriend. Cunha cannot go within 100 yards of the woman, and he also was required to relinquish all guns, ammunition and his license to carry a firearm. The woman, who says she dated Cunha between March 2006 and last January, claimed she dealt with emotional and physical abuse "many times" at the hands of Cunha and is "nervous of what he could be capable of," according to court records. The woman told Falmouth police Cunha has put his hands around her neck, thrown a chair at her and forced himself on her sexually. Although Falmouth police took initial statements, Police Chief Anthony Riello said the investigation was turned over to the Cape and Islands District Attorney's office to avoid any potential conflicts of interest... Records indicate Cunha, a longtime Falmouth resident, resides on Old Barnstable Road with his mother... Former cop's girfriend says he raped her

FALMOUTH – A restraining order against the former Falmouth cop accused of raping his ex-girlfriend has been extended for one year. Although Mario Cunha, 24, is not currently facing any charges, he is the subject of an ongoing criminal investigation... She testified yesterday that Cunha made her perform certain sexual acts even while she was crying and in pain, and also received threatening text messages from the former cop... Cunha’s attorney said there is no evidence of the text messages because the woman said she deleted them. Also, he said the six months that elapsed from the time the couple broke up to the time she reported the alleged abuse is suspect. [Full article here]

Dunne said a third party came forward to relate Cunha's alleged abuse to police, who then interviewed the alleged victim as part of an ongoing criminal investigation being conducted by the Cape and Islands District Attorney's Office...
